Notice rules

Under the federal WARN Act, employers with 100 or more employees generally must give 60 days’ written notice before a plant closing or mass layoff.

Delaware has its own rules (Delaware Worker Adjustment and Retraining Notification Act):

  • Applies to employers with 100 or more employees, not counting part-time employees (or 100 or more employees working at least 2,000 hours a week in total).
  • Employers must give at least 60 days’ written notice of a mass layoff, plant closing or relocation to affected employees and their representatives, the Delaware Department of Labor’s Division of Employment and Training, and the local Workforce Development Board.
  • Unlike the federal law, it also covers relocations: moving all or substantially all of an operation 50 miles or more away.
  • The notice must describe any payouts, severance packages, job relocation opportunities and retirement options being offered to the workers.
