Notice rules

Under the federal WARN Act, employers with 100 or more employees generally must give 60 days’ written notice before a plant closing or mass layoff.

Nebraska has its own rules (Nebraska Worker Adjustment and Retraining Notification Act (LB 921, 2026)):

  • New in 2026: the law was approved by the Governor on April 14, 2026.
  • Applies to employers with 100 or more employees, not counting part-time employees.
  • Employers must give 90 days’ written notice of a business closing or mass layoff to affected employees or their representatives and to the Nebraska Department of Labor, 30 days longer than the federal law (a union contract’s notice period governs if it sets a different one).
  • A closing or mass layoff is covered when it causes job losses for 100 or more employees at one site (for a mass layoff, within any 30-day period).
  • The notice must also be posted at work in every language spoken by at least 5% of the workforce. Violations carry a civil penalty of up to $100 a day.
