Rules and resources in New Jersey

Notice rules

Under the federal WARN Act, employers with 100 or more employees generally must give 60 days’ written notice before a plant closing or mass layoff.

New Jersey has its own rules (New Jersey WARN law (Millville Dallas Airmotive Plant Job Loss Notification Act, as amended in 2023)):

  • Employers with at least 100 employees have obligations under the state law; since April 10, 2023, part-time employees count too.
  • Employees affected by layoffs, closures or relocations must get 90 days’ advance notice, longer than the federal 60 days.
  • Notice is required whenever a mass layoff affects at least 50 workers at a worksite.
  • Employers must give discharged employees one week of severance pay for each year of service.
