Rules and resources in Washington

Notice rules

Under the federal WARN Act, employers with 100 or more employees generally must give 60 days’ written notice before a plant closing or mass layoff.

Washington has its own rules (Washington state WARN law (in effect since July 27, 2025)):

  • Employers must notify workers 60 days before a covered closure, mass layoff or reduction in hours.
  • It covers a closure affecting 50 or more full-time employees at a single worksite (permanent or temporary); a mass layoff within 30 days of 500 or more full-time employees, or of 50 or more when they are 33% of the active workforce; and cutting the hours of 50 or more workers by 50% or more in each month of a 6-month period.
  • An employer that fails to give notice and to pay back pay and benefits within 3 weeks faces a penalty of up to $500 for each day of the violation.
