Notice rules
Under the federal WARN Act, employers with 100 or more employees generally must give 60 days’ written notice before a plant closing or mass layoff.
Wisconsin has its own rules (Wisconsin business closing and mass layoff law):
- With certain exceptions, businesses employing 50 or more persons in Wisconsin must give written notice 60 days before a business (plant) closing or mass layoff in the state.
- A business closing requires notice when it affects 25 or more employees (not counting new or low-hour employees).
- If required notice is not given, affected employees may recover back pay and benefits for each day without notice, up to 60 days; complaints go to the Equal Rights Division within 300 days.
